Welcome to LifeFriend!
Please carefully review these Terms & Conditions ("Terms") before utilizing the LifeFriend mobile application (the "Service") provided by LifeFriend ("we," "us," or "our").
**1. Acceptance of Terms**
Your access to and use of the Service is subject to your acknowledgment and adherence to these Terms, which apply to all visitors, users, and others who access or utilize the Service.
You agree to be bound by these Terms by accessing or using the Service. If you disagree with any part of these Terms, you may not access or use the Service.
**2. Description of Service**
LifeFriend is a mobile application available on iOS and Android platforms that aims to assist users in enhancing their mental well-being. Through mobile notifications, users can customize the frequency and timing of receiving uplifting and motivational messages.
**3. Account Registration**
To access the Service, you must sign in with a valid Google or Apple account. By signing in, you affirm that you are 18 years old and legally capable of entering into contracts through the LifeFriend app. If you become aware of any minor using our services, please notify us immediately at info@lifefriend.io.
You are responsible for providing accurate and complete account information and safeguarding your account credentials. You agree to accept responsibility for all activities that occur under your account.

You agree to use the Service solely for lawful purposes and in compliance with these Terms, applicable laws, regulations, and ethical standards. Any attempt to disrupt the Service's integrity or access restricted areas is prohibited.
**5. Content**
LifeFriend may enable users to share various forms of content ("Content"). You are solely responsible for any Content you post on the Service and must have the necessary rights to do so. You grant LifeFriend the rights and licenses to use such Content as set forth in these Terms.
**6. Intellectual Property**
All content, features, and functionalities within the Service remain the exclusive property of LifeFriend and its licensors. Unauthorized use of LifeFriend's trademarks or copyrighted material is prohibited.
**7. Privacy**

**8. Termination**
We reserve the right to suspend or terminate your account and access to the Service without prior notice for any reason whatsoever, including without limitation if you breach the Terms. You may terminate your account anytime by ceasing to use the Service and contacting us at info@lifefriend.io.

The Service may contain links to third-party websites or services beyond LifeFriend's control. We do not endorse or assume responsibility for these third-party sites' content, privacy policies, or practices. Users should review the terms and conditions of any third-party sites visited.
**10. Disclaimer**
Your use of the LifeFriend service is entirely at your own risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
LifeFriend, its subsidiaries, affiliates, and licensors do not warrant that:
a) the service will be uninterrupted or available at any particular time or location;
b) any errors or defects will be corrected;
c) the results of using the service will meet your requirements;
d) using the Service will improve well-being or mental state;
e) content used in the Service will not harm you.
**11. Indemnification**
By using the LifeFriend service, you agree to defend, indemnify, and hold harmless LifeFriend and its licensors, as well as their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), arising from:
a) your use and access of the Service by you or any person using your account and password;
b) a breach of these Terms; or
c) content used and/or posted on the Service.
**12. Limitation of Liability**
In no event shall LifeFriend, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
(i) your access to or use of or inability to access or use the Service;
(ii) any conduct or content of any third party on the Service;
(iii) any content obtained from the Service; and
(iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not LifeFriend has been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
**13. Governing Law**
These Terms are governed by the laws of The Netherlands, without regard to its conflict of law provisions.
**14. Changes**
We reserve the right to modify or replace these Terms at any time. Material changes will be notified at least 30 days in advance. Your continued use of the Service following the effective date of the revised Terms constitutes acceptance of the changes.
**15. Communication Preferences**
By signing in with a valid Google or Apple account, you are automatically enrolled to receive newsletters, marketing communications, promotional materials, and other information from us. However, you can opt out of receiving all these communications. If you wish to unsubscribe, you can follow the instructions in any email we send.
**16. Subscriptions**
Our Service is provided on a subscription basis ("Subscriptions"). Therefore, the user must be familiar with the terms and conditions of the contract that each of the aforementioned download platforms makes available. Below are the links to access the terms and conditions of each platform:

Subscriptions are billed in advance on a recurring and periodic basis ("Billing Cycle"), typically monthly or yearly.
At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you choose to cancel it or if our company decides to cancel it. You can cancel your Subscription renewal either through the app store you are using or by contacting us at info@lifefriend.io.
A valid payment method, such as a credit card, is required to process payments for your subscription. You must provide accurate and complete billing information, including your full name, address, state, zip code, telephone number, and valid payment method information. Submitting your payment information allows us to charge all subscription fees incurred through your account using the provided payment method.
If automatic billing fails for any reason, we will issue an electronic invoice requiring you to manually complete the payment by a specified deadline corresponding to the billing period indicated on the invoice.
**17. Fee Adjustments**
We reserve the right to modify subscription fees at any time. Any changes will take effect at the end of the current Billing Cycle. We will provide you with reasonable prior notice of any change in Subscription fees to allow you the opportunity to terminate your Subscription before the new fees become effective.
Your continued use of the Service after the changes in Subscription fees have taken effect constitutes your agreement to pay the modified Subscription fee amount.
**18. Pricing and Duration of Offer Validity**
LifeFriend will transparently present pricing details within our virtual store and app. Prices may vary based on associated offers and taxes. All prices will be communicated before contracting.
**19. Payment Methods and Security**
Various payment methods are available for purchasing services. LifeFriend does not retain payment information for security purposes.
**20. Taxation Considerations**
Prices may fluctuate based on applicable taxes.
**21. Trial Period**
Upon subscription, you may receive a trial period. Charges will apply after the trial period unless canceled.
**22. Cancellation Policy**
Subscriptions can be canceled anytime, effective from the next billing period.
**23. Refunds**
Except as required by law, subscription fees are non-refundable.
**24. Receipts**
Users can access receipts and purchase history within the app stores.
Additionally, users are advised that all communications, purchase orders, and associated payments conducted within the app may be documented and retained in the digital records of LifeFriend. This is primarily to serve as evidence of transactions while ensuring adherence to reasonable security measures and compliance with relevant laws and regulations, particularly those pertaining to consumer protection and personal data security.
